SIFIDE — the System of Tax Incentives for Business Research and Development — is one of the main instruments supporting business innovation in Portugal. Created in 1997 and currently administered by the National Innovation Agency (ANI), SIFIDE aims to increase the competitiveness of companies by encouraging investment in Research and Development (R&D) activities.

 

This incentive takes the form of a tax benefit, allowing companies to deduct a significant portion of R&D expenses incurred throughout the fiscal year from their IRPJ (Corporate Income Tax). How does SIFIDE work?

 

SIFIDE allows a IRC tax deduction corresponding to two components:

  1. Basic Rate (32.5%)
    Deduction of 32.5% of total R&D expenses.
  2. Incremental Rate (50%)
    Additional deduction of 50% of expenses that exceed the average of the two previous years, up to a limit of R$1.5 million.

 

This model rewards not only continued investment in R&D, but also its growth over time. If the company cannot use the entire deduction in the tax year in question, the amount may be reported for eight consecutive tax years.

 

 

Eligible Expenses

 

R&D expenses eligible for SIFIDE include, among others:

  • Costs of personnel directly involved in R&D activities;
  • Acquisition of scientific instruments and equipment;
  • Acquisition of patents;
  • Expenses for scientific and technical audits;
  • Expenses for participation in research institutions and technology centers;
  • Expenses for contracting accredited entities R&D.

 

It is important to highlight that only expenses actually incurred and related to R&D activities are eligible, and a rigorous documentary proof process is required.

 

 

Companies Eligible for SIFIDE

 

One ​​of the most significant advantages of SIFIDE is its scope: it is available to all companies operating in Portugal and subject to the organized accounting regime.

 

 

Eligibility Criteria

 

To benefit from SIFIDE, the company must meet the following requirements:

  1. Be subject to IRPJ (Income Tax) — The incentive is applied in the form of a tax deduction, therefore, only companies with profits (or prospects for future profits) can benefit from the mechanism.
  2. Have organized accounting — Companies must keep rigorous accounting records that demonstrate the allocation of expenses to R&D activities.
  3. Conduct R&D activities as defined by law — The activities must fall within the concept of R&D, according to OECD criteria (Frascati Manual), meaning they must involve novelty, creativity, uncertainty, systematization, and transferability or reproduction.
  4. Submit the application by the deadline — The application to SIFIDE must be submitted by the end of May of the year following the fiscal year to which the expenses relate.
  5. No tax or Social Security debts — Companies with debts to the State are not eligible until they regularize their tax situation.

The incentive applies to companies in any sector of activity, as long as they invest in R&D. Examples of sectors that frequently use SIFIDE include:
