

{"id":2134,"date":"2025-09-05T10:10:52","date_gmt":"2025-09-05T10:10:52","guid":{"rendered":"https:\/\/uhy.pt\/compensation-funds-fct-and-fgct\/"},"modified":"2025-09-22T10:37:12","modified_gmt":"2025-09-22T10:37:12","slug":"compensation-funds-fct-and-fgct","status":"publish","type":"post","link":"https:\/\/uhy.pt\/en\/compensation-funds-fct-and-fgct\/","title":{"rendered":"Compensation Funds (FCT and FGCT)"},"content":{"rendered":"<p class=\"p1\">On the 15th of December 2023, <span class=\"s1\">Decree-Law No. 115\/2023<\/span> was published, amending the legal regimes of the Work Compensation Fund (FCT) and the Work Compensation Guarantee Fund (FGCT).<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><b>FCT:<\/b><\/p>\n<p>&nbsp;<\/p>\n<p class=\"p2\">In accordance with the established legal amendments, the FCT becomes a closed fund, constituted by the overall balance in the employer&#8217;s account (the obligation to join and make contributions to the fund definitively ceases). This overall balance is a merger of the individual accounts of each worker.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p2\">The value of the employer&#8217;s account balance can be mobilized at different periods, based on the available amount (The value can be mobilized between the last quarter of 2023 and December 31, 2026):<\/p>\n<ul class=\"ul1\">\n<li class=\"li2\">For companies with an available balance up to <b>\u20ac400,000<\/b>, the mobilization of the value can be done up to <b>two times<\/b>.<\/li>\n<li class=\"li2\">For companies with an available balance exceeding <b>\u20ac400,000<\/b>, the mobilization of the value can be done up to <b>four times<\/b>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p class=\"p2\">It is necessary to manage the number of allowed mobilizations because, after 2 or 4 mobilizations that do not total the account balance, the excess is forfeited in favor of the compensation funds.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p2\"><span class=\"s1\">Decree-Law No. 115\/2023<\/span> brought changes to the possible purposes of utilizing the available balance:<\/p>\n<ul class=\"ul1\">\n<li class=\"li2\">Financing of worker qualification and training.<\/li>\n<li class=\"li2\">Support for costs and investments related to worker accommodation; ~<\/li>\n<li class=\"li2\">Support for investments agreed with workers&#8217; representative structures, or with them, notably daycare centers and cafeterias.<\/li>\n<li class=\"li2\">Payment of up to 50% of the compensation for termination of contracts of workers included in the FCT.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p class=\"p2\">To access the respective balance, the employer must request through the <b>compensation funds portal<\/b>, declaring under a commitment of honor:<\/p>\n<ul class=\"ul1\">\n<li class=\"li2\">The amount they intend to mobilize.<\/li>\n<li class=\"li2\">The purposes of the mobilization.<\/li>\n<li class=\"li2\">The employer must previously consult the collective representation structures of the workers or proceed with prior communication to the workers, verifying the absence of reasoned opposition.<\/li>\n<li class=\"li2\">If the purpose is to support other investments agreed with representative structures, the same agreement must be presented.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><b>FGCT:<\/b><\/p>\n<p>&nbsp;<\/p>\n<p class=\"p2\">The changes brought by Decree-Law No. 115\/2023, of December 15, regarding the Work Compensation Guarantee Fund are as follows:<\/p>\n<ul class=\"ul1\">\n<li class=\"li2\">The suspension of communication of accession to the FGCT<\/li>\n<li class=\"li2\">The suspension of incurring debts to the FGCT and the procedures for their regularization.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>On the 15th of December 2023, Decree-Law No. 115\/2023 was published, amending the legal regimes of the Work Compensation Fund (FCT) and the Work Compensation Guarantee Fund (FGCT). &nbsp; &nbsp; FCT: &nbsp; In accordance with the established legal amendments, the FCT becomes a closed fund, constituted by the overall balance in the employer&#8217;s account (the [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":1189,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[53],"tags":[],"class_list":["post-2134","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-outsourcing-en"],"acf":[],"_links":{"self":[{"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/posts\/2134","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/comments?post=2134"}],"version-history":[{"count":0,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/posts\/2134\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/media\/1189"}],"wp:attachment":[{"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/media?parent=2134"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/categories?post=2134"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/uhy.pt\/en\/wp-json\/wp\/v2\/tags?post=2134"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
